1. About this Policy

This Policy covers how Swyftx Pty Ltd (ABN 72 623 556 730) and our related bodies corporate ("Swyftx", "our", "us" or "we") collect credit-related Information and why, how we handle it, and the rights and choices available to you.

Our Swyftx Privacy Policy sets out how we collect and handle other types of personal information and should be read in conjunction with this Policy.

For our crypto-backed loan product, we act as an Agent Credit Provider for Web3 Ventures Pty Ltd (trading as "Block Earner"), the Principal Credit Provider. 1.1 Definitions

"Personal information" refers to information or an opinion about an individual, where that individual is identified or reasonably identifiable, and as defined under applicable laws.

"Credit-related information" is personal information relating to credit that has been provided to an individual or that they have applied for. This Policy covers, where applicable, "credit information" and "credit eligibility information" as defined under the Privacy Act 1988 (Cth) and as outlined in section 3 below.

"Handles" refers to the collection, use, disclosure, holding, or otherwise processing of information.

"Agent Credit Provider" and "Principal Credit Provider" refer to terms set out in sections 6G and 6H of the Privacy Act 1988 (Cth).

2. Collection and Method

We may collect and handle the following types of credit-related Information, together with personal information, directly from you or an authorised representative, when you interact with our Services, and from third party sources, including from a Credit Reporting Body.

If you decline to provide us with your credit-related information we believe is necessary to complete the credit application process, we may decline to offer you our product and services.

2.1 Credit information

When you apply for credit through us, we may ask you for general personal information about you, such as information and evidence of your financial and personal standing and loan intentions, nominated and verified bank account details. If your credit is approved, we collect transaction information, which is used to create repayment history information.

Together with this information, we may obtain the following credit information when you apply for credit through us:

  • Identification information - full name, date of birth, gender, residential address, driver's license information; and

  • Existing credit limits, and fiat principal amount requested.

We may obtain the following credit information from use of our Services or from Block Earner:

  • Consumer credit liability information, such as the limit amount, terms and conditions, and the day credit was entered, terminated or otherwise ceased to be in force;

  • Repayment history and financial hardship information;

  • Default, payment, and new arrangement information; and/or

  • Serious credit infringement notifications, as of the opinion and made by Block Earner, in relation to credit provided.

2.2 Credit eligibility information

We may obtain the following credit reporting information from a Credit Reporting Body listed in this Policy:

  • Identification information, such as your full name, alias, date of birth, gender, current or last known, and previous addresses, current or last known employer, driver's license number;

  • Consumer credit liability information, such as your credit history, including the type, limit amount, terms and conditions, and the day credit was entered, terminated or otherwise ceased to be in force;

  • Repayment history and financial hardship information;

  • Credit report information request history;

  • Type and amount of credit applied for;

  • Default, payment, and new arrangement information;

  • Serious credit infringement notifications, as of the opinion and made by a credit provider, in relation to credit provided; and/or

  • Court proceedings or personal insolvency information;

  • Publicly available information, relating your credit worthiness; and/or

  • Credit Reporting Body-derived information - your credit score or rating.

We may obtain the following Credit-Provider derived information or generate from use of our services:

  • Internal evaluation and assessment information, including risk assessment and evaluations of creditworthiness used in our or Block Earner's decision-making process and decision outcomes.

3. Purposes

We collect and handle credit-related Information for the following purposes where permitted, required or authorised under law:

  • Confirm your identity;

  • Make an information request with a Credit Reporting Body (via Block Earner);

  • Validate your nominated bank account details;

  • Risk assess and evaluate your creditworthiness as part of our decision-making process to determine if you are eligible for credit ("pre-assessment check")

  • If you meet our pre-assessment check, to confirm with Block Earner their determination of your eligibility for credit ("final assessment"), credit loan limit amount and associated details;

  • To manage your credit account, including to track payments and due dates, and to manage any associated payments;

  • To communicate with you and manage our relationship with you, including to notify or update you about your credit loan status and activities and respond to your requests;

  • To deal with complaints and regulatory matters relating to you, including any involvement of an external regulator or dispute resolution scheme, to facilitate the resolutions of such matters;

  • For other relevant internal administrative and management purposes where permitted, including record keeping, insurance, auditing, fraud prevention, risk analytics, regulatory reporting, and internal financial tracking that relates to the credit;

  • For consideration in any other application made by you for our Products and Services. We will not use credit eligibility information for this purpose;

  • To inform our direct marketing communications, if you are opted in. We may use credit eligibility information only to exclude individuals from receiving such communications on the basis that the individual is at significant risk of defaulting in relation to credit entered; and/or

  • To comply with a court or tribunal order, lawful enforcement body request, or legal obligations applicable to us, including Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth) and responsible lending obligations under the National Consumer Credit Protection Act 2009 (Cth), and other laws that apply to is, including corporations, taxation, and financial service laws.

4. Disclosures

4.1 Our disclosures

We may disclose credit-related Information we hold in the following circumstances:

  • with your consent; or

  • for the purpose it was collected for, including as described in section 4 of this Policy; or

  • where it is otherwise permitted, required or authorised by law.

We may disclose certain types of credit-related information to the following types of third parties where permitted:

  • Block Earner, the Principal Credit Provider;

  • Credit Reporting Bodies listed in this Policy;

  • Our related entities, employees, agents, contractors, and service providers that help us deliver the credit product;

  • Our professional advisors including our lawyers and accountants, and insurers;

  • Anyone who lawfully represents you or anyone to whom you have consented to the information being disclosed;

  • Law enforcement bodies, government agencies or bodies, regulatory authorities, courts or tribunals, including but not limited to: responding to a lawful request for information relating to their enquiries and/or investigations, such as suspected or actual unlawful activity or misconduct; a court or tribunal order; for the establishment, exercise or defence of a legal or equitable claim; or as otherwise permitted or required by law; and/or

  • Companies that we propose or plan to merge with, be acquired by, or who may invest with us, in so far as legally permitted, including to enable the assessment or completion of the relevant merger, restructuring, financing, acquisition, divestiture, dissolution, or other corporate change or transfer.

In certain circumstances, we may disclose certain credit-related information to an entity without an Australian link, including for purposes described in this Policy. The countries where we may use, store or transfer credit-related information include Australia, New Zealand, the United States of America, South Africa, and the Philippines. We take reasonable steps to ensure a lawful transfer mechanism applies, such as entering into binding agreements with third parties to ensure compliance with applicable privacy laws.

The following notifiable matters apply with respect to interactions with these Credit Reporting Bodies:

  • As Principal Credit Provider for the crypto-backed loan product, Block Earner directly interacts with these Credit Reporting Bodies as part of applying and offering credit.

  • Together with Block Earner, we do not obtain an individual's consent to make an information request to these Credit Reporting Bodies, in accordance with law.

  • A record of the information request may be used and as relevant, disclosed for the purposes of these Credit Reporting Bodies, Swyftx, and Block Earner, to assess the individual's credit worthiness. This includes calculation of a credit score or credit rating (subject to any other use or disclosure limitations under applicable laws).

  • The information request may affect your credit score or credit rating calculated by these Credit Reporting Bodies.

  • If an individual fails to meet their payment obligations in relation to the credit provided or commits a serious credit infringement, Block Earner may be entitled to disclose this to these Credit Reporting Bodies.

  • These Credit Reporting Bodies may include information disclosed to it in its reports provided to other credit providers to assist them to assess the individual's credit worthiness.

5. Your Rights and Choices

5.1 Rights and choices you can make with us

You, or an authorised representative, have the right to make the following requests with respect to credit-related Information that we may hold about you:

  • access to a copy of your credit-related information held by us; or

  • correction of your credit-related information held by us; or

  • make a complaint about our handling of your credit-related Information held by us; or

  • request a copy of this Policy in a particular form, such as in hard copy. Both this Policy and the Swyftx Privacy Policy are available online at https://www.swyftx.com.au.

We may ask you first to put your request in writing, and to verify your identity and the identity of your authorised representative, if relevant. We will provide you with an outcome to your request in a reasonable and timely manner. If we are unable to fulfil your request, we will share with you our reasons and the review and complaint mechanisms available to you. You can make a request by reaching out through the contact details set out in section 7 below.

With respect to the correction of your credit-related information, we may be unable to do so where we believe, for the purposes for which it is held, it is accurate, up to date, complete, relevant, and not misleading. You may ask us to keep an associated statement that you believe the information is inaccurate, out of date, incomplete, irrelevant and/or misleading.

If you are unsatisfied with the outcome of your request, you can contact us to discuss your concerns. Swyftx is a member of the Australian Financial Complaints Authority ("AFCA"). AFCA offers a free external dispute resolution service for individuals who are unable to resolve an issue with a covered entity directly. AFCA will generally ask if you have tried to resolve the issue with us first. You also have the right to make a complaint about us to the Office of the Australian Information Commissioner. 5.2 Rights and choices you can make with a Credit Reporting Body

A Credit Reporting Body may use your credit reporting information obtained to assist credit providers directly market to you by 'pre-screening' you to determine your eligibility for their campaigns. If you do not want your information to be used for this purpose, you can contact the Credit Reporting Body directly to opt-out.

If you believe on reasonable grounds that you have been or are likely to have been a victim of fraud, you can directly ask a Credit Reporting Body not to use or disclose your credit reporting information. 6. Updates to this Policy

We reserve the right to change this Policy from time to time, as may be required to keep it accurate and up to date. We will take reasonable steps to notify known individuals covered by this Policy of material changes through available communication channels.
